Si el seguro no me paga, existen dos vías para que la aseguradora me pague lo que toca en el plazo legal establecido: La judicial y la administrativa.
La vía judicial
Cuando una aseguradora no te paga lo que te debe por vía amistosa debes acudir a la vía judicial. Esta consiste en presentar una reclamación a un juzgado y allí esperar el día del juicio para que el juez resuelva el asunto, dándote la razón en base al marco legal establecido. Piensa que una cosa es la justicia y otra distinta es la legalidad, y los jueces aplican la Ley, que en ocasiones puede ser injusta.
La vía administrativa: La DGSFP
Cuando alguien incumple las normas existen los policías, donde puedes denunciar los delitos. También existen los inspectores de hacienda cuando hay un tema de irregularidades con los impuestos, los inspectores de trabajo cuando hay irregularidades en asuntos sociales o de los trabajadores, etcétera. Las malas aseguradoras pueden reírse de ti, pero no hay ninguna, ni las buenas ni las malas, que se rían de la DGSFP. Al contrario: ¡Tiemblan! Y la función principal de la DGSFP es regular el sector asegurador para proteger y defender a los ciudadanos del Estado español.
Por tanto, la DGSFP puede solicitar a la aseguradora que cumpla con la obligación de pagarte en el plazo establecido y además sancionar a esa aseguradora si ha visto que ha obrado en contra de las leyes españolas que regulan el sector.
