La cobertura y sus limitaciones
Los contratos de seguro cubren los daños debidos a la acción de la lluvia, englobándola dentro de la garantía de «fenómenos atmosféricos» o la también denominada «lluvia, viento, pedrisco o nieve». Cada aseguradora lo «bautiza» como quiere.
Ahora bien, habitualmente los seguros limitan la cobertura siempre y cuando haya una intensidad de precipitación superior a 40 litros por metro cuadrado y hora a modo que si supera esa intensidad sí que lo cubre y si no, no lo cubren.
Y ¿cómo saben las aseguradoras que se ha superado el límite de precipitación?
Las aseguradoras, o sus peritos, consultan las webs oficiales estatales, autonómicas o locales que dan información sobre este aspecto. Consultan la estación meteorológica más cercana al sitio donde ha habido el incidente. Si supera los límites se cubren los daños por lluvia y si no no se cubren.
Atención con el concepto de intensidad de precipitación
No es lo mismo circular a 120 Km/h, que es un concepto de velocidad, que decir que entre Barcelona y Girona hay 120 Km, que es un concepto de distancia. Las dos cifras son de 120 y el concepto de Km está de por medio, pero la primera es velocidad y la segunda es distancia.
Resulta que no es lo mismo la intensidad de precipitación, asimilable a la velocidad de un vehículo y que se mide el litros por metro cuadrado y hora, y la precipitación habida en cierto lugar, equivalente a la distancia entre dos poblaciones y que se mide en litros por metro cuadrado. Lo que importa es la intensidad de precipitación, equivalente a la velocidad.
Cláusulas delimitativas y limitadoras de derechos en los daños por lluvia
Y como siempre hablamos, la garantía de fenómenos atmosféricos o lluvia es una clausula delimitativa, pero la condición de intensidad (40 litros metro cuadrado y hora) es una cláusula limitativa de derechos del asegurado, donde si no está específicamente aceptada por escrito no puede aplicarse. De este modo, es posible que con una simple lluvia quede cubierto el siniestro.
