En este post daremos los detalles más importantes en los que se fija un perito para evaluar un siniestro de responsabilidad civil patronal y saber si hay o no cobertura según el contrato firmado entre asegurado (empresa) y asegurador.
Responsabilidad de la empresa
Toda empresa debe tener un plan de prevención, el cual marca las estrategias y políticas que debe llevar a cabo para que no se produzcan accidentes de ningún tipo, ni de lesiones en trabajadores ni daños en las cosas.
Evaluación de riesgos
Por tanto la primera cosa que debe hacer una empresa es evaluar los peligros y calibrar los riesgos o probabilidad que se produzca un accidente.
Planificación preventiva
Una vez evaluados los riesgos, la empresa deberá planificar las medidas necesarias (soluciones) para tratar los riesgos, a modo de minimizar los accidentes, tanto laborales como de cualquier otro tipo.
Para con los trabajadores
Por tanto es misión del empresario informar y formar a todo el personal respecto a los riesgos a los que están sometidos, entregar los Equipos de Protección Individual (EPI’s) necesarios para cada tipo de actividad desarrollada por cada empleado según el puesto de trabajo que ocupa, y obviamente, someter a una revisión médica a cada empleado para determinar si es apto para desarrollar el trabajo encomendado.
Habitualmente esto puede hacerlo una empresa o subcontratarlo a una empresa de Prevención de Riesgos Laborales.
Si embargo el perito, en caso de siniestro de accidente laboral, mirará las siguientes cosas del trabajador y la empresa:
- Que el trabajador haya sido informado por la empresa (documento acreditativo)
- Que el trabajador haya recibido y superado la formación en materia de riesgos laborales, ergonomía y salud. (Documento acreditativo de recibir la formación)
- Que la empresa le hubieran entregado los EPI’s (documento acreditativo de entrega de los EPI’s)
- Que haya superado el informe médico y es apto para desarrollar esa actividad (documento acreditativo de aptitud). En este punto hay actividades que deberá realizarse una revisión médica periódica y otras, en el caso de un administrativo de una empresa, donde no será necesario y el trabajador podrá renunciar.
- Que la labor que se le encomendó cuando sucedió el accidente esté dentro de las tareas propias de su puesto de trabajo.
Dependiendo de cada circunstancia, es posible que haya más o menos problemas con el seguro a la hora de cobrar la indemnización.
